What is the protection term of a patent in Turkey (Türkiye)?

In Turkey, patents are protected for 20 years. This period begins on the date of application. However, for the protection to continue throughout 20 years, a renewal fee (i.e., annuity, annual fee, maintenance fee) must be paid annually to the Turkish Patent and Trademark Office. The annuities need to be paid not only for registered patents but also for pending applications.


When is the due date for patent annuities in Turkey?

In Turkey, annuities for a patent (or a patent application) are paid in advance for the third year and each subsequent year. The due date of the annuity for the third year is the second anniversary (corresponding month and day) of the application date. The due dates of the subsequent years are also based on the anniversary of the patent application. As the annuities are updated each year, these fees should be paid after the updated fees of the relevant year are published in the fee tariff in the Official Gazette.


Is there a grace period for the payment of patent annuities in Turkey?

Yes. Within an additional period of 6 months after the due date of an annuity, it is possible to pay the relevant annuity by paying a higher fee to the Turkish Patent and Trademark Office.

What information do you need for the payment of patent annuities?

Do you need a power of attorney?

No. We do not need a power of attorney for the payment of patent annuities.


When will you pay the annuity of my patent to the Turkish Patent and Trademark Office?

Do I need to be represented by a Turkish patent and/or trademark attorney for patent renewals in Turkey?

Yes. Patent owners (natural or legal persons) who reside outside of Turkiye must be represented by a Turkish patent attorney before the Turkish Patent and Trademark Office, for all patent-related filings including the payment of patent annuities.


Will my renewal instructions be filed by a registered patent and/or trademark attorney?

Yes. All your instructions will be filed with the Turkish Patent and Trademark Office by a registered patent and trademark attorney, i.e., Mr. Dogukan Berk Aksoy from Aksoy IP, a full-service IP agency and law firm based in Ankara, Turkiye.
